The Official Employees Committee in the Enron Bankruptcy

This case arose out of Enron's action on the eve of bankruptcy. In the last days before the bankruptcy filing, Enron paid out multimillion-dollar "bonuses" to key officers. Representing one of two official committees in the Enron bankruptcy, Mark Maney was lead trial counsel in an action challenging the bonuses as unfair preferences and fraud. Although opposed by many of the country's largest law firms, the Bankruptcy Court entered a landmark opinion establishing new bankruptcy law and calling for the return of all of the bonuses. The funds recovered went to pay severance for Enron employees who lost their jobs and much of their savings.
